The Ministry of Justice has recently published the draft law on the amnesty of prisoners, from which it is known that at least 570 convicts benefit.
According to preliminary data, as a result of this initiative, the criminal prosecution for most of the criminal misdemeanors punishable by up to 2 years is terminated.
Meanwhile, all men and 1.5 women and minors who do not benefit from amnesty like others benefit from a 1-year sentence reduction, and those sentenced to life, those for murder and subjects of SPAK are excluded from this initiative.
The amnesty enters into force 15 days after publication in the Official Gazette, while it has not been applied for several years.
Who benefits from the amnesty?
Excluded from serving the sentence:
1) male persons, convicted by a final court decision, with imprisonment up to 3 years or any other type of milder punishment, including a fine or one of the types of alternatives to imprisonment, for punishments given up to the date 30.06.2023, regardless of the time remaining from the sentence.
2) female persons, convicted by a final court decision, with imprisonment up to 4 years or any other type of milder punishment, including a fine or one of the types of alternatives to imprisonment, for punishments given up to the date 30.06.2023, regardless of the time remaining from the sentence.
3) male persons, sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this sentence for up to 3 years.
4) female persons, sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this sentence for up to 4 years.
5) female convicted persons, who, on the date of entry into force of this law, are equal to or over the age of 50.
6) male convicted persons, who, on the date of entry into force of this law, are equal to or over the age of 65.
7) persons sentenced to imprisonment, who, at the time of committing the criminal offense, were equal to or under the age of 18.
8) All convicted persons, who do not meet the criteria to be exempted from serving the sentence, according to point 1, of this article, or, even though they meet the criteria for benefiting from amnesty according to this article, are not exempted from serving the penalty due to the prohibitive criteria defined in point 1 and 2, article 4 of this law, shall be deducted:
9) 1 year and a half for convicted persons, women, and minors;
10) 1 year for convicted persons, men.
