The Law Commission has approved the draft law on asylum. This draft law provides for the prohibition of entry and stay in the Albanian state for all convicted persons, who are considered as at risk of violating security. According to the Law Commission, this draft law is made according to European standards for all asylum seekers.

But why were these changes made and which ones?

From the meeting of the Commission, the rapporteur Elena Xhina said that in the article where the convicted persons are detained, it should be clarified that it is not about the persons who violate the public security but the persons who violate the security of the Albanian state.

specifically: In Article 11, point 3b, the change is proposed due to the fact that it is not about acts that violate public order and security, but it is about acts that violate order and security in the Republic of Albania. So, if we look carefully at how the sentence continues, it is not at all about acts that violate public order and security, as we also have acts that are noise in the environment, we have endless acts, while when we talk about acts that violate the order and security of the Republic Albania, are serious offenses. The fact that he was removed "minimum 7 years" was due to the fact that there were offenses punishable by 10 years or more for these types of crimes. We will consider it in the security commission to find the title that belongs to the head of the criminal code so that we do not have such problems, to clarify that it is a violation of state security and not public safety.

Unlike the existing law, there is a deadline for reviewing the request by the structure responsible in the relevant ministry for asylum and refugees, which, as a rule, lasts 6 (six) months from the date of submission of the request, extension cases which are made for an additional period of 3 (three) months, and a maximum time limit has been set for the completion of the review of the request which is 21 (twenty one) months from its submission.

The draft law also defines the meaning of persecution, as well as the actors of persecution.

The rapporteur asked the working group of the Ministry of Interior to make a more correct clarification that can be reviewed in the Security Committee.
